TERMS OF USE

These terms of use govern the use of https://ginaclements.com, the materials, information and related services contained in this website and made available to you. By accessing or using this website in any manner, you agree to be bound by these Terms of Use. If you disagree with any of the website terms and conditions contained herein, you must not use this website. Fuelled by Yoga may occasionally update these Terms of Use and in the event that you do not agree with the change(s) please discontinue use of the site.

In these terms and conditions, all references to ‘I’ , ‘we’ and ‘us’ refer to 'Gina Clements' and 'ginaclements.com'.

Cancellations

All bookings and payments made in all 'Gina Clements' classes and workshops are non-refundable.

Zoom online classes

These can be cancelled up to 15 minutes before the class starts. Classes cancelled after this time will be forfeited. If you cancel a class which has already been paid for, within the designated time frame, you will receive a credit for a class which must be used within 14 days. Refunds are only given in exceptional circumstances.

In-person classes

Can be cancelled up to one hour before the class starts. Classes cancelled after this time will be forfeited. If you cancel a class which has already been paid for, within the designated time frame, you will receive a credit for a class which must be used within 14 days.

COVID-19 UPDATE: If the studio is closed as a result of lockdown, any pre-paid classes will automatically be transferred to Zoom online sessions.

Private sessions

If you cancel a private yoga session within 24 hours of the appointment, you will forfeit that session. You can reschedule your appointment if you cancel with a minimum of 24 hours notice.

Workshops

If you have paid for a workshop and are unable to attend, you will forfeit your place.

If for any reason we need to cancel a workshop entirely, we will notify you prior to the event and offer you an alternative date.

Intellectual Property Rights

'Gina Clements' and/or its licensors own all information, communications, photography, text, images, graphics, logos and other materials contained in this Website. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.

Limitation of Liability

Neither 'Gina Clements' nor any of its employees, or agents will be liable for any loss or damages, directly or indirectly occurred, arising out of or in connection with your use of this website, following any course or class and/or the information contained in it. It is your responsibility to ensure that you are capable of undertaking yoga sessions with us whether online or in person.
In no event shall 'Gina Clements' be liable for any damages whatsoever resulting from the interruption, suspension or termination of any services, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.

Indemnification

As a user of this website, you hereby indemnify to the fullest extent 'Gina Clements' from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way out of any violation by you of these Terms Of Use.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions will be deleted without affecting the remaining provisions herein.

You must not:

  • Publish, distribute, sub-licence or sell any website material in any form

  • Use material from this website for public shows or performances

  • Use this website in any way that may cause damage to the website or performance impairment, availability or accessibility of the website

  • Use this website in any way that is illegal, unlawful, fraudulent or harmful, or in connection with any illegal, unlawful, fraudulent or harmful purpose or activity

  • Conduct any data collection activities including data mining, data scraping, data harvesting or data extraction in relation to this website

'Gina Clements' reserves the right to revise these terms and conditions from time to time. By using this website you are expected to review these terms on a regular basis. We will notify you 30 days in advance if these changes apply to you.

You hereby agree that 'Gina Clements' may assign, transfer and subcontract or otherwise deal with our rights and/or obligations under these Terms and Conditions. These Terms and Conditions, together with our Privacy and Cookies policy constitutes the entire agreement between 'Gina Clements' and you in relation to your use of this website and supersedes any prior agreements and understandings related to such use.

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of the United Kingdom and you hereby submit to the non-exclusive jurisdiction of the state courts located in the UK for the resolution of any disputes. This will not prevent 'Gina Clements' from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these terms and conditions in any other jurisdiction throughout the world.

This privacy policy explains how ginaclements.com, use any personal information we collect about you. We are committed to ensuring that your privacy is protected. All personal information we collect from you on this site is treated as confidential.

ginaclements.com provides yoga and wellbeing services.

  • When you complete our health questionnaire we will collect the following personal information:

    • Details about whether you have practiced yoga before, which types and for how long

    • A brief medical history

    • Details of other exercise you participate in.

  • When you book a class online we collect your name, email address and phone number (optional).

  • Details of your interactions with us online, e.g. Feedback, queries, complaints, and details of purchases you’ve made with us.

  • When you leave a comment on the site.

  • Anonymous data about your use of our website via cookies in your web browser. Read more about cookies below.

  • Your social media username if you interact with us via those channels.

  • To process your booking requests.

  • The data collected on the health questionnaire will be used to:

    • Contact you should we need to about your class or event bookings

    • Enable us to assess your suitability for the classes

    • Safeguard your health and tailor your class or event experience

    • Send you any marketing communications that you have opted into.

  • To respond to your queries, feedback, refund requests, complaints, as well as to record your appointment and purchase history and online conversations. We may also keep a record of any communication with you in order to inform future responses to you and to monitor our customer service.

  • To contact you about your bookings or purchases with us.

  • With your consent, we will use your personal information for notifying you via email of products or services we think may be of interest to you.

  • To send you communications which are required by law or which are necessary to inform you about changes to our services and privacy policy. These messages will not include any promotional content.

  • To comply with our legal obligations to share your personal information with Law enforcement should a valid request be received.
    When you leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

We take personal information security very seriously and will take all necessary precautions to ensure the safety of your personal information.

We partner with Wix website to store and process your data on secure servers. Access to your personal information is password protected.

We maintain administrative and physical safeguards that are intended to appropriately protect against accidental or unlawful destruction, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing, of the personal information in our possession.

7. How long will we keep your personal information?

We may need your personal information to to comply with our legal obligations, to protect us in the event of disputes and to enforce our agreements. For this purpose, we will always retain your personal information for 7 years after the date it is no longer needed by us for any of the purposes listed under ‘How we use your personal information’.

If you leave a comment on the website, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

In order to process your online gift voucher orders and payments, we need to share your personal data with third parties outside the European Economic Area (EEA), i.e. the USA.

Your personal information will be processed in line with the Wix privacy policy in these cases.

  • Access to the personal information we hold about you.

  • Correction of your personal information if incorrect or out of date.

  • That we stop using your personal information for marketing purposes.

We may make a small charge for this service.  We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate.

If you have consented to receive marketing from us, you may opt out at anytime by following the unsubscribe instructions in any marketing email received.

CANCELLATION POLICY

All class bookings are non refundable unless the instructor cancels the booking. In the case that the instructor cancels the class, the student will be fully refunded. If the student cancels the booking with more than 24 hours notice they are then able to reschedule the booking for a future date within two weeks, subject to my availability. If it is less than 24 hours notice, a 50% class fee will be charged.
